Adequacy of the State Enterprise Model in the Single Market

Summary

This publication presents the general principles and enterprise-specific proposals on how to arrange the orgainization of unincorporated state enterprises in situations where the conventional model for public undertakings is not applicable as such in the Single Market (Commission decision C 7/2006).

Based on the general principles, in a competitive market, government assets must be used in such a way that they do not favour the business operations of state enterprises or those of any other company. Business operations in state enterprises are exercised primarily in the form of limited companies. A business run in the form of a state enterprise can be a permanent form of operation only on condition the enterprise is not operating on the competitive market by offering its goods or services to those outside government (in-house).

In line with this, the project formulated a government proposal to amend the State Enterprise Act (1185/2002) so that in future state enterprises may operate only in the role of an in-house unit in such a way that it provides services for government agencies and bodies. In its meeting on 6 March 2009, the Cabinet Committee on Economic Policy endorsed this proposal and those relating to the general principles for individual enterprises, according to which, government proposals will be made in the course of the project to convert the Civil Aviation Administration, the Finnish State Pilotage Enterprise, Shipping Enterprise Finstaship into limited companies, and proposals to change the organization of Metsähallitus and Senate Properties will be presented.
